General Terms and Conditions
De Betuwse Hengelsportzaak
1. Applicability
1.1 These general terms and conditions apply to all offers, orders and agreements of De Betuwse Hengelsportzaak.
1.2 These terms and conditions may only be deviated from in writing with the express permission of De Betuwse Hengelsportzaak.
1.3 The terms and conditions are accessible to everyone via the website of De Betuwse Hengelsportzaak.
1.4 By placing an order, the customer declares that they agree to these general terms and conditions.
2. Purchase agreement
2.1 A purchase agreement is concluded when the customer places an order in the online shop.
2.2 The customer and De Betuwse Hengelsportzaak expressly agree that an agreement is legally concluded without a signature.
2.3 After placing an order, the customer will receive a confirmation email containing the order details.
2.4 Additional agreements are only binding if they have been confirmed in writing by both parties.
2.5 De Betuwse Hengelsportzaak is not responsible for errors or inaccuracies made by the customer when entering information.
2.6 In the event of a delivery delay exceeding 30 days, the customer has the right to terminate the agreement, unless agreed otherwise or if the goods were specially ordered.
2.7 De Betuwse Hengelsportzaak reserves the right to refuse orders or accept them subject to conditions.
2.8 Images, photographs and drawings are for illustrative purposes. Only the items and accessories stated in the product description are binding.
3. Prices
3.1 All prices are stated in euros, including VAT and excluding shipping costs.
3.2 Prices are subject to printing, typesetting and typographical errors.
3.3 No rights may be derived from errors in stated prices.
3.4 The price at the time of ordering applies.
4. Payment
4.1 Payment must be made using the payment methods offered in the online shop.
5. Cancellation and returns
5.1 An order may be cancelled free of charge within 24 hours of placement, provided that this is reported in writing (by email).
5.2 If the order has already been shipped, the shipping and return costs will be borne by the customer.
5.3 The customer has the right to return products within 14 days of receipt, provided that they are unused, undamaged and in their original packaging.
5.4 Vouchers, gift vouchers, credit vouchers and gift cards are excluded from returns and refunds.
5.5 Specially ordered or custom-made products cannot be returned.
5.6 Shipping costs (outward and return) will be borne by the customer.
5.7 If part of an order is returned, the shipping cost arrangement may be applied again if the remaining order falls below a certain amount.
5.8 For payments made through payment providers (such as PayPal, credit card or similar services), transaction fees may be charged for returns.
5.9 The customer is responsible for ensuring that the return shipment is correct and insured. The customer bears the risk of damage or loss during return transport.
5.10 For returns of low value, De Betuwse Hengelsportzaak may issue a refund in the form of a discount code.
6. Delivery
6.1 Delivery will only take place after full payment in advance.
6.2 Delivery is subject to availability.
6.3 Orders that are fully in stock are generally shipped within 3 to 5 working days after receipt of payment.
6.4 Delivery times are indicative; no rights may be derived from them.
6.5 If a product is not in stock, the customer will be informed and consulted about how to proceed.
6.6 No replacement products will be supplied without consultation.
7. Disputes and applicable law
7.1 A dispute will be deemed to exist as soon as one of the parties declares that one exists.
7.2 All agreements are governed exclusively by Dutch law.
7.3 Disputes will be submitted to the competent court in the Netherlands, to the exclusion of all other authorities.
8. Liability
8.1 The liability of De Betuwse Hengelsportzaak is limited to no more than the invoice amount of the relevant order.
8.2 De Betuwse Hengelsportzaak is not liable for indirect damage, consequential damage or business losses.
8.3 De Betuwse Hengelsportzaak is not liable for damage occurring after delivered products have been put into use or modified.
8.4 De Betuwse Hengelsportzaak is not liable for damage caused by the unavailability of the online shop.
8.5 Product information, advice and answers are indicative; no rights may be derived from them.
8.6 The customer indemnifies De Betuwse Hengelsportzaak against claims from third parties.
9. Warranty
9.1 Products are covered solely by the manufacturer's or wholesaler's warranty, unless stated otherwise.
9.2 De Betuwse Hengelsportzaak acts solely as an intermediary between the customer and the manufacturer/wholesaler.
9.3 This intermediary role ends once the manufacturer's warranty has expired.
9.4 Shipping costs for warranty claims will be borne by the customer, unless agreed otherwise.
